Helmick, Secretary;&nbsp; Board Members, Lyda Lister, Bruce Stalnaker, Ron Roth;&nbsp; along with Cindy Cook, Resort Mananger;&nbsp; Debbie Stevens of Stevens&#39; Realty and Management and&nbsp; Doug Richie with Points Professionals.<br><br>Represented:&nbsp;&nbsp;&nbsp;&nbsp; 77 unit weeks&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; 87 attendance<br><br>President, Lawrence &quot;Skip&quot; Eller called the meeting to order.<br><br>Resort Manager, Cindy Cook read the proof of notice.<br><br>Minutes from our June 26,2010 annual meeting -- Herb Richardson moved to disburse with the reading of the minutes since all in attendance were given a copy; seconded by Bruce Stalnaker; motion carried.<br> <br>Introduction of officers and staff by President Eller<br> <br>Herb Richardson - I think this is a lot better than going to the Canaan Valley State Park.&nbsp; I&#39;m the VP/Treasurer.&nbsp; I get to keep an eye on the finances.&nbsp; I am very pleased with the upgrades at the resort.&nbsp; If you get the chance drive by the resort and take a look at it.<br><br>Bruce Stalnaker - I&#39;m running for the board again this year.&nbsp; We have done a lot of work over the past few years, and I&#39;m looking forward to the future.<br><br> Lyda Lister - As you can see and hear, they need a woman on the board to help keep these guys in order.&nbsp; I&#39;ve enjoyed being on the board and seeing these improvements come to pass.&nbsp; I think we have a great resort.&nbsp; Without you and your support we cannot do these things.&nbsp; We have more improvements to come.<br> <br>Ron Roth - This is my 5th year of being on the board.&nbsp; Utilities board, I had no idea what it was and now I am the President and have a much better understanding of the Land of Canaan Utilities.&nbsp; A lot of good things are going to happen this year including wireless internet services.<br><br>Jerry Helmick - I truly cannot remember how many years it has been now but I truly enjoy my involvement with the resort.&nbsp; I work very close with Cindy and the girls at the resort with the deed prep and signing of the deed for the resort owned properties.&nbsp; I also help to keep the web-site up and going.&nbsp; I too am up for re-elections this year and would love to be given the opportunity to serve another term.&nbsp; Thank you!<br><br> Debbie Stevens - I was hoping to give each of you a presentation but there is no internet service here.&nbsp; I was appointed in 2007 and there was indeed a lot for me to learn.&nbsp; I would like to take a few minutes to go over some recent changes.&nbsp; Last year after the annual meeting I spent several months reviewing online booking programs, that was no easy task due to the face that we are a Saturday to Saturday resort.&nbsp; On-line rentals became a reality in January of this year.&nbsp; The web-site for on-line rentals is <a href="http://www.rusticrentals.net"> www.rusticrentals.net</a>.&nbsp; We need your help in driving up it&#39;s availability by clicking on the site.&nbsp; In addition to the on-line booking system we now have rental liability insurance with any on-line booking with the option of travelers insurance upon request.&nbsp; We will also be launching a new site called landofcanaanrentals.com which will be like a questions and answer forum with additional information.&nbsp; We also encourage you to visit the landofcanaan.com web-site.&nbsp; Be sure and get your rental agreements in as soon as possible to give us as much time as we can to rent your unit.&nbsp; If you have a new physical address or contact information please make sure that we have the information.&nbsp; Land of Canaan also has a Facebook page, please suggest us to your friends so that we can grow our database.&nbsp; And finally, we have sold 13 units in 2011 with 8 of them belonging to the homeowner&#39;s association.<br><br> Doug Richie - I&#39;m with the RCI division as a points professional representative.&nbsp; I am going to share with you some information that was recently published by the timeshare industry.&nbsp; There is an information request form in the back if you have any questions please fill them out and get them back to me as soon as possible.&nbsp; I will gladly answer any questions that you may have at the conclusion of today&#39;s meeting.<br><br>Skip Eller - The letter that went out to the association I believe explains all the work that has been done at the resort this past year.&nbsp; We have had some issues with some roof damage that needed to be taken care of before it developed into a bigger issue.&nbsp; Each of you should have been given a non-smoking ballot.&nbsp; The board has decided to execute a vote to make the resort a non-smoking resort.&nbsp; We have had numerous complaints from the past guests about entering units where someone has been smoking.&nbsp; If this passes, the board has agreed that in the event that someone breaks the non-smoking policy they will have to pay a $250.00 damage deposit.&nbsp; Please take out your ballot and vote at this time.<br><br>Question and Answer Session:<br><br>Q: B6-35 (Cyrus) - Are there going to be any employee raises for the upcoming year?<br>A: No, there are no planned employee raises for this year.&nbsp; Over the course of the past 4 years some of the budgeted amount in the employee wages has been re-classified as needed.<br><br> Non-Smoking Policy Vote - Ballots were counted and the resort was 389 for a Non-Smoking Resort and 38 against making the resort&nbsp; a Non-Smoking Resort.<br><br>President Eller asked the association if there was any Unfinished Business - There was no unfinished business to discuss.<br> <br>President Eller opened the floor for discussion on the proposed 2011-2012 budget.<br> <br>Q: G1-09 (White) - There are no employee&#39;s raises for this year is that correct?<br>A: That is correct, there were no wage increases this year.&nbsp; We did have to make some adjustments to wage categories due to the increase in the minimum wage.<br><br>Q: How many u nits are there total and how do you determine how many units to base your budget on?<br>A: We have 2,084 total unit weeks and take away 42 owned by the resort for our maintenance weeks.&nbsp; So we have a total of 2,042 unit weeks that should be paying maintenance fees.&nbsp; We average the income from those who are currently paying their maintenance fees.&nbsp; We do use a conservative figure to help insure that we do not overspend.<br><br>Q: E2-35 (Hurst) - Do you make money on units that are not being used?<br> A: Yes, if they are 4 years or more past due, we will attempt to rent their units and credit the rent money received back to their maintenance fee accounts.<br> <br>Q: How long do units owner&#39;s get away with not paying for their maintenance fees:<br>A: It costs the resort an average of $4,000.00 per unit to complete a foreclosure process.&nbsp; As each of you can see, we simply do no have that money available in our budget for such an expense.&nbsp; We do our best to try to collect past due maintenance fees and to work out payment option for the unit owners.&nbsp; We are also looking into a collection agency to help us collect on some of these past due accounts.&nbsp; The collection agency will report delinquencies directly to the credit bureaus which should help to entice better payment history.<br><br>Q: Are homeowners eligible for a discounted rental fee?<br>A: Yes, $55.00 a night or the maintenance fee for the week if there is something available at that specific time.<br><br>Q: A1-30 (Sayre) - Can a prevision be placed on any new sale that can state that if they fail to pay their maintenance fee the unit defers back to the association:<br>A: No, we tried that a few years ago and were told that it was not legal to do so.<br><br>Q: Why does the association require a 100% majority vote to move ahead instead of the majority of voting members?<br>A: We must comply with the code of conduct with the timeshare resort and West Virginia state code.&nbsp; And furthermore, that is what is mandated by the resort&#39;s original by-laws.<br><br>Q: E2-32 (Lees) - I think having the maintenance fees due in July is a wonderful thing, I think that it is much better to work on&nbsp; our fiscal year instead of the calendar year where our maintenance fees would be due shortly after the holidays.&nbsp; My question is do you ever send out a quit claim deed to those who want to deed their units back to the resort?<br>A: Yes, we are currently doing that and have been for several years now.<br> <br>Q: E3-20 (Farnham) - We pay our maintenance fees every year, but miss out on exchanged because we haven&#39;t paid our maintenance fee in advance.&nbsp; Can anything be done for those of us who pay our maintenance fees faithfully every&nbsp; year so that we will not run into this problem in the future?<br> A: This is actually an RCI issue not a Land of Canaan issue.&nbsp; RCI is now calling the resort and asking for verification on maintenance fees and specific year&#39;s being paid.&nbsp; We are simply answering their questions truthfully.<br><br>Q: E2-32 (Lees) - I own at 4 other resorts and this is the only resort I have to pre-pay.<br>A: Again, it is an RCI issue and not that of Land of Canaan.<br> <br>Q: A6-12 (Woodrum) - Question on page #13 of the audit sheet, uncollectable accounts, what is that?<br>A: The report is prepared by our auditor and I&#39;m assuming it is the portion of uncollected maintenance fees, late fees, and liens, but I&#39;m really not sure.&nbsp; We will get that information for you in the future.<br><br>Q: A6-19 (Fortney) - Debbie, you said taxes are paid through the resort to the county, is it possible to not pay the taxes for the owners who are delinquent in their maintenance fees?<br>A: No, because each unit has 52 owners.<br><br> 2011-2012 budget - Hallie Hurst of E2-35 moved to accept the proposed budget has presented; seconded by Lyda Lister; motion passed by show of hands.<br><br> President Eller opened up the floor for nomination for the two vacant seats.&nbsp; Herb Hunt of B2-36 nominated Jerry&nbsp; Helmick; seconded by Connie Roth of D5-51.&nbsp; Herb Richardson of B1-22 nominated Bruce Stalnaker; seconded by Carol Eller of G6-37.<br><br>Mr. McDaniels of B3-15 moved that nomination to be closed; seconded B6-35; motion carried.<br> <br>President Eller casted the deciding vote, welcome back.<br> <br>Door prizes were given.<br> <br>The association made available a list of blue units to be given away to those of interest.<br><br>Jerry Helmick moved to adjourn;
